COMSA Affiliate Program Terms of Service

The COMSA Affiliate Program Terms of Service (hereinafter referred to as the “Agreement”) apply to the “COMSA Affiliate Program,” which is a referral (affiliate) service provided by Tech Bureau, Corp. (hereinafter referred to as the “Company”). This Agreement establishes the relationship of rights and obligations between the Company and the COMSA Affiliate Program members defined in Article 2, Section 2, as well as former COMSA Affiliate Program members. For matters not stipulated in this Agreement, the COMSA Terms and Conditions apply.

Article 1 (Overview)

The COMSA Affiliate Program is a program under which the Company pays compensation to any member of the COMSA Affiliate Program (defined in Article 2) in the case that a member of the COMSA Affiliate Program uses media to introduce COMSA to a user who is not registered to COMSA (hereinafter referred to as an “Unregistered COMSA User”), and that aforementioned Unregistered COMSA User subsequently uses the referral link provided by the aforementioned member of the COMSA Affiliate Program to register as a COMSA member, and moreover uses a service to which compensation applies (to be determined separately), or in the case that the set goal for compensation is met.
A COMSA Affiliate Program member is a person who is a COMSA member who has completed the membership registration procedure at COMSA, and who has agreed to this Agreement and registered for the COMSA Affiliate Program in accordance with the method prescribed by the Company.
The COMSA Affiliate Program member can use a unique referral link and banner issued via the COMSA Affiliate Program page of their account.
Via their COMSA Affiliate Program page, COMSA Affiliate Program members can verify the usage of compensation-related services by Unregistered COMSA Users who became registered members via the unique referral link or banner. However, they cannot see information related to specific individual registrants.
If a COMSA Affiliate Program member wishes to cancel their registration as a member of the COMSA Affiliate Program, they can cancel their registration as a COMSA Affiliate Program member by withdrawing from the program in accordance with the withdrawal procedure prescribed by the Company.
Members of the COMSA Affiliate Program shall faithfully comply with this Agreement and the terms, rules, guidelines, and similar that accompany this Agreement.

Article 2 (Applicability of this Agreement)

A COMSA Affiliate Program member is a person who has registered as a COMSA Affiliate Program member for the purpose of using the COMSA Affiliate Program, and who entered into a relationship of rights and obligations between the Company and the COMSA member concerned upon agreeing to this Agreement in addition to the COMSA Terms of Service.
This agreement shall apply to members of the COMSA Affiliate Program from the moment they register as a COMSA Affiliate Program member until the moment their COMSA Affiliate Program membership is canceled. However, Articles 8 through 10 shall apply to COMSA Affiliate Program members even after their COMSA Affiliate Program membership is canceled.

Article 3 (Compensation)

The compensation targets of the COMSA Affiliate Program, as well as compensation conditions, payment receipt dates, and so on are described separately on the explanation page of the COMSA Affiliate Program as well as on the COMSA Affiliate Program user page that becomes accessible to members after they register for the COMSA Affiliate Program.
A COMSA Affiliate Program member can earn compensation (to be determined separately) in the case that an Unregistered COMSA User uses the referral link provided by the aforementioned member of the COMSA Affiliate Program to register as a COMSA member, and moreover uses a service to which compensation applies, or in the case that the set goal for compensation is met. However, if the COMSA Affiliate Program member violates this Agreement or is no longer a COMSA Affiliate Program member, the aforementioned member of the COMSA Affiliate Program shall no longer be entitled to compensation (including compensation generated before the aforementioned member of the COMSA Affiliate Program engaged in the behavior that violated this Agreement, or compensation generated before the aforementioned member of the COMSA Affiliate Program left the program).

Article 4 (Changes to this Agreement)

The Company may change this Agreement from time to time, and when changes to this Agreement set forth in Section 2 take effect, COMSA Affiliate Program members shall be deemed to have accepted those changes.
Unless otherwise specified by the Company, changes made to this Agreement shall take effect when the details of the changes are displayed on our website or when the details of the changes are sent to each COMSA Affiliate Program member by email, whichever comes first.

Article 5 (Representations and Warranties)

Upon applying for registration, a person who wishes to register as a COMSA Affiliate Program member (hereinafter referred to as the “Applicant”) declares that they meet all the conditions listed below, and guarantees that this situation will continue during the period in which the Agreement is in effect. The Company shall have the right to reject an application for registration if the Applicant is found to be in violation of the guarantees set out in this section, or if the Applicant is judged to be unsuitable for registration for or use of the service.
(1) The Applicant understands and is able to read and write either Japanese or English.
(2) The Applicant does not operate any websites that endorse violence or abuse, websites that endorse racism, websites that violate laws, or websites that are contrary to public order and morality.
(3) The Applicant is not an organized crime group, a member of an organized crime group, an associate member of an organized crime group, a person connected to an organized crime group, a corporate blackmailer, or similar (hereinafter collectively referred to as “Antisocial Forces”). The Applicant does not directly or indirectly interact with Antisocial Forces, provide funds or accommodations to Antisocial Forces, do business with Antisocial Forces, or maintain any other type of relationship with Antisocial Forces, and has no capital ties to Antisocial Forces.
(4) The Applicant has not appointed Antisocial Forces as staff or hired them as employees.
(5) The Applicant has not provided false information while registering for COMSA, or provided false information while registering for the COMSA Affiliate Program.
(6) The Applicant does not aim to obtain compensation from the Company through the COMSA Affiliate Program in an unauthorized fashion.
(7) The Applicant has not canceled a registration for the COMSA Affiliate Program in the past.
(8) The Applicant possesses the capacity to discern right and wrong and understands the details of this Agreement and the COMSA Affiliate Program.
(9) The Applicant does not qualify as someone who is otherwise deemed unsuitable for registration by the Company.
If after registration as a COMSA Affiliate Program member, a COMSA Affiliate Program member is found not to meet any of the aforementioned conditions, the Company shall have the right to cancel the registration for the COMSA Affiliate Program of the aforementioned COMSA Affiliate Program member without prior notification.

Article 6 (Prohibited Conduct)

Members of the COMSA Affiliate Program shall not engage in any of the conduct established below (hereafter referred to as “prohibited conduct”).Members of the COMSA Affiliate Program shall not engage in any of the conduct established below (hereafter referred to as “prohibited conduct”).

(1) Possession of two or more accounts per single registration category by the same individual or corporation (however, this excludes cases where the company has granted special permission).

(2) Interfering with the operations of the company, regardless of whether it is intentional or accidental.

(3) Infringing on the copyrights of the company and its other rights.

(4) Defaming the company, or a third party, which harms reputations and inflicts losses.

(5) Infringing on intellectual property rights and other copyrights, personality rights, likeness usage rights and other legal rights, as well as rights worthy of protection, or conduct that violates related laws and regulations.

(6) Violating the privacy of third parties.

(7) Performing activities that are illegal or suspected to be illegal, as well as actions which instigate these activities.

(8) Qualifying as any sort of antisocial force, or interacting—whether directly or indirectly—with any parties which qualify as antisocial forces, offering them funding or facilities, conducting business with them or possessing other relationships with said forces, as well as taking actions that result in possession of capital ties with antisocial forces.

(9) Appointing antisocial forces to staff positions, or employing them as workers.

(10) Making COMSA referrals by means of conduct that qualifies as religious activity or political solicitation.

(11) Engaging in conduct that misleads regular users into making judgment errors, as well as conduct that this company deems to have a negative influence on the judgment of regular users.

(12) Displaying false information relating to the COMSA Affiliate Program.

(13) With regard to this company’s services and the like, presenting something not grounded in objective fact so that it will be mistaken as being objective

(14) With regard to the company’s services and the like, making displays that are arbitrary or excessively subjective

(15) Making inappropriate displays which are neither impartial nor based on objective grounds

(16) Making displays that excessively solicit dealings with the company

(17) Engaging in conduct that is illegal or forbidden by this company

(18) Altering advertising materials or referral codes, or using them for other purposesAltering the referral links provided by this company (advertising materials as well as those link codes) without permission, using them for purposes other than the COMSA Affiliate Program, or using them for improper purposes.

(19) Extortion to Receive Success RewardsUnrelated to this company’s services or this website’s referrals and advertising, forcibly demanding clicks, registrations, payments, transactions or subscriptions from regular users with the primary aim of collecting fees.

(20) SpammingAdvertising in ways that cause trouble for third parties, such as sending spam emails and advertising through posts on bulletin boards, as well as other methods and means.

(21) Performing acts which impede the operations of this company’s servers or website, such as hacking, improper means, as well as usage frequency that exceeds acceptable limits.

(22) Forced ReferralsForcibly rewriting regular users’ cookies in media, regardless of the means, via inline frames, refresh tags and other measures.

(23) A COMSA Affiliate Program member completing registrations, subscriptions, deposits and transactions by oneself, or with the reciprocal cooperation of a third party, for personal profit.

(24) Inducing a excessive sense of danger about currency collapse in regular users

(25) A COMSA Affiliate Program member procuring COMSA Affiliate Program rewards through improper means.

(26) Using an inappropriate website as a place for this company’s advertisements

(27) Engaging in conduct equivalent to any of the previous items.

(28) Other conduct, for the reason that the company recognizes it as a special offense

This company shall make a judgment as to whether or not an activity falls under prohibited conduct, and this company assumes no obligation to elaborate on details or its reasoning to COMSA Affiliate Program members.

If this company suspects that a COMSA Affiliate Program member is engaged in conduct that comes under any item in paragraph 1 of this article, the company can demand that the aforementioned COMSA Affiliate Program member submit documents related to the presence or absence of prohibited conduct. In addition, to safeguard the security of the system that administers this service, this company will not, in the absence of special circumstances, disclose the criteria for the abovementioned judgments to COMSA Affiliate Program members as a general rule.

Article 7 (About Revocation of Membership)

In the event that a COMSA Affiliate Program member’s conduct falls under any of the following items, this company has the right to instantly suspend this service for the aforementioned member, or cancel their membership, without prior notice. In the event that a COMSA Affiliate Program member’s conduct falls under any of the following items, this company has the right to instantly suspend this service for the aforementioned member, or cancel their membership, without prior notice.

(1) When they have breached this contract.

(2) When they have committed an illegal act.

(3) When contact is judged to be impossible by this company, after emails addressed to the COMSA Affiliate Program member’s email address fail to be delivered more than three times, etc.

(4) When the company has determined that it is improper for the member to continue to possess their membership.

The COMSA Affiliate Program member shall, upon revocation of membership, delete all previously posted links.Even if the COMSA Affiliate member suffers losses as a result of this item, this company shall bear absolutely no responsibility for reparations.

Article 8 (Restitution)

In the event that a dispute arises between a COMSA Affiliate Program member and a third party relating to the use of the COMSA Affiliate Program by the aforementioned COMSA Affiliate Program member, the concerned COMSA Affiliate Program member shall bear all responsibility for its resolution.

If the event that a COMSA Affiliate Program member causes damage to this company in relation to usage of the COMSA Affiliate Program, they shall pay damages in full (an amount containing the entirety of, but not limited to, the necessary legal fees of this company).

Article 9 (Prohibition of Transfers)

With regard to their rights, obligations and positions based on this contract, COMSA Affiliate Program members shall not be allowed to transfer, succeed, collateralize or dispose of them through other means.

Article 10 (Governing Laws and Jurisdiction)

This usage contract shall be governed by Japanese law.

All disputes relating to this service shall be submitted to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
